36 MONTH 3000 HOUR LIMITED WARRANTY
DYNA Sales and Service, LLC (“Manufacturer”) warrants all new equipment which is manufactured by the Manufacturer and purchased by the initial end-user customer (“Customer”) from an authorized dealer to be free from defects in materials and workmanship and for a period equal to the Warranty Period (as defined herein), however, to the Customer’s strict compliance with all of the terms and conditions outlined in this Limited Warranty ( “Warranty”).
For any valid Warranty claim, the Manufacturer will at its sole option replace or repair at a point designated by the Manufacturer, any parts which were defective in material or workmanship during the Warranty Period. The Manufacturer is not responsible for labor (Unless equipment is taken to an authorized dealer / service center and warranty is approved by the Manufacturer), consequential damages, traveling expenses, downtime expenses, or shipping and freight charges.
Warranty Period
For purposes hereof, the “Warranty Period” shall commence upon the Warranty Commencement Date (as defined herein) and continue for the lesser of three (3) calendar years and or 3,000 hours. With the exception of conveyor belts and splitting wedges, these have a one (1) year warranty. The “Warranty Commencement Date” shall mean the earlier of the following dates: (a) the date of sale of the equipment to the Customer, (b) one (1) year after delivery of the equipment to the authorized dealer, (c) for equipment which is used as a rental, lease or loaner, the first day in service, or (d) for equipment which is used in demonstrations, upon accumulation of 75 hours of operation. DYNA Sales and Service, LLC may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.
This Warranty takes effect upon the Warranty Commencement Date provided that the Warranty Validation Form is completed, signed, and returned to DYNA Sales and Service, LLC in accordance herein within 5 business days after the Warranty Commencement Date. The Warranty is NULL AND VOID if the Warranty Validation Form is not completed as required under this Warranty, signed, and returned within 5 business days after the Warranty Commencement Date.
THIS WARRANTY AND ANY POSSIBLE LIABILITY OF DYNA SALES AND SERVICE, LLC. IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND OF ANY NONCONTRACTUAL LIABILITIES INCLUDING PRODUCT LIABILITIES BASED UPON NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO CERTAIN CUSTOMERS. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, DYNA PRODUCTS, LLC. LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.
DYNA SALES AND SERVICE, LLC WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT OR LOST PROFITS RESULTING FROM ANY BREACH OF THIS WARRANTY.
All parties involved agree that the Customer’s sole and exclusive remedy against the Manufacturer, whether in contract or arising out of this Warranty, instructions, representations, or defects shall only be for the replacement or repair of defective parts as provided herein. In no event or circumstances shall the Manufacturer’s liability exceed the purchase price of the equipment. The Customer also agrees that no other remedy (including but not limited to lost profits, consequential or incidental loss) shall be available to the Customer.
The Customer must submit the Warranty Validation Form, completely and accurately filled out with signature to warranty validation email (warrantyvalidation@dyna-products.com) within five (5) business days from the date of purchase (or Warranty Commencement Date, if earlier) to validate this Warranty. All Warranty consideration is NULL AND VOID If the Warranty Validation Form has not been submitted in a timely manner.
Exclusions and Limitations
This Warranty will not apply if the equipment is operated or repaired with replacement parts or equipment not manufactured or recommended by DYNA Sales and Service, LLC.
This Warranty will not apply if the equipment is not operated in the manner recommended by the Manufacturer. The following examples would void the Warranty:
1. The completed Warranty Validation Form was not timely or accurately submitted within 5 business days after the Warranty Commencement Date.
2. The equipment was misused, abused, neglected, modified, or not serviced properly.
3. Repairs or attempted repairs made without prior written authorization.
4. Repairs made due to normal wear are not warrantable.
5. The equipment was involved in, or damaged by an accident, disaster, or hazard (such as fire, flood, wind, or lightning), or other actions or events beyond DYNA Sales and Service, LLC’s reasonable control.
6. The equipment was damaged during shipment or from any type of foreign material.
This Warranty will not apply if all scheduled maintenance as explained in the Operators Manuals has not been timely and properly completed. The Customer is responsible for all scheduled maintenance as explained in the Operator’s Manuals. Accident, fire, Improper maintenance, or any other negligence, including failure to adjust, tighten, or replace wear items (such as knives, anvil, teeth, belts, bars, chains, lubrication fluids, bearings, filters, hydraulic components, loose nuts, or bolts, etc.) will void this Warranty.
This Warranty will not apply if the equipment is re-sold to a customer or dealer or if the Customer purchased the equipment from a person or entity that is not an authorized dealer. This Warranty is not assignable, and any assignment or other transfer of this Warranty shall be null and void.
This Warranty does not cover or apply to consumables, such as but not limited to, knives, anvil, teeth, belts, bars, chains, lubrication fluids, bearings, filters, tires, winch rope, fan paddles, bar studs and nuts, operator error and or misuse.
All components and parts being returned for Warranty Consideration must be complete and assembled when delivered. Warranty will be denied if the failed component has been disassembled at any point in time. Hydraulic components and parts must be returned assembled with all fluid ports capped or plugged and free of foreign contamination, or the Warranty will be denied. Any defective part replaced under this Warranty becomes the property of DYNA Sales and Service, LLC. The replacement part will be covered under the standard Warranty for the remainder of the original Warranty Period.
Any parts that are requested to be returned for warranty evaluation must have an RMA # assigned to them by DYNA Sales and Service, LLC Any components returned without the proper paperwork will automatically be discarded and the warranty denied.
DYNA Sales and Service, LLC warrants all new parts which are manufactured by the DYNA Sales and Service, LLC and purchased by the Customer outside of this Warranty from an authorized dealer to be free from defects in materials and workmanship for a period of 90 days from date of purchase; provided, however, such warranty shall apply to parts only and not labor.
NOTICE
This Warranty applies only to new and unused equipment or parts thereof manufactured by DYNA Sales and Service, LLC, and does not apply to components thereof that are not manufactured by DYNA Sales and Service, LLC. This Warranty is also void if the equipment is modified or operated with any replacement parts or equipment not manufactured or recommended by DYNA Sales and Service, LLC. Any replacement parts not purchased or approved by DYNA Sales and Service, LLC in its sole discretion will not be covered under warranty.
All other components that are not manufactured by DYNA Sales and Service, LLC are subject to any warranty provided by their respective manufacturers (i.e., engines, axles, hydraulic pumps and motors, clutches, tires, batteries, etc.). Even though certain warranties are not handled through DYNA Sales and Service, LLC, the warranty procedure for those components should be facilitated through DYNA Sales and Service, LLC, or your nearest authorized dealer. DYNA Sales and Service, LLC will provide a pass-through warranty with these outside vendors on the customer/dealer’s behalf, but it is ultimately up to the respective vendor’s discretion if the components are indeed warrantable failures or not.

NOTICE
Clutch and engine maintenance (air filter maintenance, oil changes, oil filter maintenance, etc.) are important to your equipment. Refer to the clutch or engine manual for the maintenance schedule. Failure to perform the clutch or engine maintenance will void the Warranty with the respective manufacturer. DYNA Sales and Service, LLC does not warrant these components.
Warranty Claims
To process any Warranty claims, the Customer/Dealer must fill out a Warranty Claim Form on the DYNA Sales and Service, LLC portal located on the DYNA Sales and Service, LLC website. The form along with pictures and the detailed information below must be submitted within 10 business days after the failure to the Manufacturer or an authorized dealer (who will forward it to the Manufacturer). Notwithstanding anything to the contrary herein, before any repairs are made. A warranty claim must be filed and approved by, DYNA Sales and Service, LLC at WARRANTY CLAIMS EMAIL @ (warrantyclaim@dyna-products.com) of the failure (with above process) so that DYNA Sales and Service, LLC. can advise on how to proceed with the proper repairs. Once repairs are complete the warranty claim can be closed.
If a Return Merchandise Authorization (RMA) is given to return the failed parts, the failed parts must be returned within 10 business days to the respective vendor or DYNA Sales and Service, LLC depending upon the instructions given. Failure to do so will result in the warranty claim being denied. The new parts must be installed, and work be completed within 10 business days of receiving the replacement parts to receive credit.
It is necessary to include all the following information on all Warranty claims:
1. Warranty Claim Form, obtained from DYNA Sales and Service, LLC, or its authorized dealers, completely and accurately filled out online
2. Name of Dealer and where purchased
3. Date of purchase and delivery
4. Serial number of unit
5. Model number of unit
6. Engine make and serial number
7. Length of time in use (hours on)
8. Date of Failure
9. Nature of Failure
10. Pictures of failure and surrounding areas of the machine where failure accrued.
Only Warranty Claim Forms (and the underlying Warranty claims) which are so submitted within 10 business days of the failure, and which are then approved by an authorized administrator of the Manufacturer will be considered valid. If a Warranty Claim Form is not submitted within 10 business days of the failure, the Warranty claim will be automatically denied.
DYNA Sales and Service, LLC, reserves the right to alter, improve, revise, or modify any parts or products. DYNA Sales and Service, LLC may also change design, specifications, or part prices without advance notice in its sole discretion.
DYNA Sales and Service, LLC is NOT responsible for updating or upgrading completed equipment with design changes made after its production.
DYNA Sales and Service, LLC may require the Customer to bring their equipment to the Dealer/Manufacturer for Warranty repairs. The Manufacturer DOES NOT pay Dealers or Customers for travel time, travel costs, diagnostic services, or overtime pay. The Manufacturer does not furnish loaner equipment or reimburse for rental equipment.
If warranty claims are approved DYNA Sales and Service, LLC, will reimburse the Company or companies at a labor rate of $120.00 per hour, and the cost of any parts approved within the claim as well, along with any shipping charges. ALL items will be pre-authorized before approval is provided for reimbursement. If the dealer has the parts in stock, once the warranty claim is approved by DYNA Sales and Service, LLC, The dealer can use approved parts from their stock, then replenish their stock when the parts arrive from DYNA Sales and Service, LLC.
